No-fault divorce

The Divorce, Dissolution and Separation Act 2020 reformed the divorce process to remove the concept of fault.  The act came into force on 6th April 2022. The new legislation replaces the 'grounds for divorce' and allows couples to divorce without assigning fault, it removes the possibility of contesting the divorce and introduces the option for a joint application. These changes also apply to the dissolution of civil partnerships.

The only ground for divorce is that the marriage has irretrievably broken down. This is often referred to as ‘no-fault divorce’.
